Listed below are the General Conditions of Carriage for Passengers and Baggage applicable to flights operated by JS Aviation.

General Conditions of Carriage for Passengers and Baggage

(SUBSCRIPTION / FOR AIR / CONNECTED FLIGHTS)

 

These General Terms and Conditions of Carriage are the only general terms and conditions binding on JS Aviation, Joen Service Oy. Other air carriers have issued general conditions of carriage which may differ from these general conditions of carriage and which apply to air services.

DEFINITIONS OF ARTICLE 1

 

In these circumstances, the following applies:

"We", "our", "ourselves" or "we" means JS Aviation.

"You", "you" or "yourself" means a person, other than a crew member, who is or will be carried on an airplane under a contract or ticket.

  "Authorized Agent" means the passenger sales representative we have appointed to represent us in the sale of air services.

  "Suitcase" means your personal belongings that accompany you during the trip. Unless otherwise noted, it consists of both your checked and unchecked baggage.

"Terms and Conditions" means the text contained in or provided on your ticket or itinerary / receipt that is marked as such and that includes, with reference to these Terms and Conditions of Carriage and Notices.

'Convention' means any of the following:

 

i) Montreal Convention (1999)

 

(ii) the Convention for the Unification of Certain Rules for International Carriage by Air, signed at Warsaw on 12 October 1929 (hereinafter referred to as the Warsaw Convention);

 

(iii) the Warsaw Convention, as amended at The Hague on 28 September 1955;

 

(iv) the Warsaw Convention, as amended by the Montreal Additional Protocol No. 1 of 1975;

 

(v) the Warsaw Convention as amended at The Hague and Montreal Additional Protocol No 2 (1975);

 

(vi) the Warsaw Convention as amended at The Hague and Montreal Additional Protocol No. 4 (1975);

 

(vii) Additional Meeting of Guadalajara (1961) (Guadalajara).

 

"Damage" includes the death, injury or bodily injury to a passenger, loss, partial loss, theft or other damage resulting from the carriage or other related service.

 

“Days” means calendar days, including all seven days of the week; provided that the date of dispatch of the notification is not calculated for the purpose of notification; and, in addition, the date on which the ticket is issued or the flight commenced shall not be taken into account for the purpose of determining the duration of the ticket.

  “Force Majeure” means unusual and unforeseen circumstances beyond your control and the consequences of which could not have been avoided even if all care had been taken. "Passenger" means any person, other than a member of the crew, carried or carried on an airplane under a ticket. (See also definitions of "you," "you," and "yourself.")

  “SDR” means a Special Drawing Right as defined by the International Monetary Fund. "Tariff" means the published fares, rates and / or associated conditions for the carriage of an airline which have been communicated to the appropriate authorities, as appropriate.

 

  "Ticket" means either a document entitled "Travel Ticket and Baggage Receipt" or an electronic ticket, connecting flight confirmation and receipt, or a subscription agreement issued in each case either by us or on our behalf, and includes terms and conditions, notices and coupons.

"Unchecked baggage" means any baggage other than hold baggage.

 

 

ARTICLE 2 SCOPE

 

2.1 GENERAL

Except as provided in Sections 2.2, 2.4 and 2.5, our Conditions of Carriage apply only to flights operated by us, on an airplane operated under the name JS Aviation

 

2.2 ORDER OPERATION

If the carriage is in accordance with a charter or flight taxi contract or as a connecting flight, these conditions of carriage apply.

 

LEGISLATION 2.4

 

These Conditions of Carriage shall apply unless they conflict with the tariffs or applicable law, in which case such tariffs or laws shall prevail.

However, if any provision of these Conditions of Carriage is invalid under applicable law, the other provisions will remain in full force and effect.

 

2.5 THE TERMS APPLY EXCEEDING THE REGULATIONS

Unless otherwise provided in these Conditions of Carriage, these Conditions of Carriage shall prevail in the event of any inconsistency between these Conditions of Carriage and any other provisions we may have in force concerning certain matters.

 

ARTICLE 3 - NOT APPLICABLE

 

ARTICLE 4 - TRANSPORT PRICES, TAXES AND OTHER CHARGES

 

4.1 PRICES

 

Prices only apply to transfers from the airport of departure to the airport of destination, unless otherwise stated. Prices do not include ground transportation services between airports or between airports and city terminals. Your price will be calculated as agreed in the booking agreement or in the confirmation and receipt of the connecting flight.

 

4.2 TAXES, CHARGES AND CHARGES

 

The applicable taxes, fees and charges shall be levied by the government or other authority or airport managing body. Taxes and fees for air travel are constantly changing and may be charged after the date of the agreement. If the tax or charge specified in the agreement increases, you must pay it. Similarly, if a new tax or charge is still imposed after the contract, you must pay it. Similarly, if any taxes or fees you have paid to us at the time of entering into this Agreement are removed or reduced so that they no longer apply to you, or if a lower amount is paid, you are entitled to claim a refund. We reserve the right to charge a reasonable administration fee for such a refund.

 

4.3 CURRENCY

 

Prices, taxes and fees will be paid in the currency of the country where the contract is made, unless we or our authorized representative have indicated another currency at the time of payment or prior to payment (for example, due to non-convertibility of the local currency). We may, in our sole discretion, accept payment in another currency.

 

ARTICLE 5 - RESERVES

 

5.1 BOOKING REQUIREMENTS

 

5.1.1 We or our authorized representative will record your booking. Upon request, we will provide you with a written confirmation of your booking.

 

5.1.2 The booking agreement or confirmation of the connecting flight and the receipt may limit or exclude the right to change or cancel reservations.

 

5.3 PERSONAL INFORMATION

 

You understand that personal information has been provided to us for the following purposes: making a reservation, purchasing a ticket, acquiring additional services, developing and providing services, facilitating immigration and entry procedures, and making such information available to government agencies for the purpose of your trip. For these purposes, you authorize us to store and use such​​ information and pass it on to our own offices, authorized representatives, government agencies, other operators or service providers.

 

5.4 SEATING POSITION

 

We cannot guarantee any particular location. We reserve the right to reassign or rearrange seats at any time, including after boarding. This may be necessary due to other safety arrangements.

 

ARTICLE 6 - CHECK - IN AND BOARDING

 

6.1 The check-in schedule is different at each airport and we recommend that you check and follow these check-in times. Your trip will be smoother if you give yourself enough time to check in at check-in times. We reserve the right to cancel your booking without refund if you do not comply with the stated check-in times. We or our authorized representatives will provide information on the check-in time for your first flight. You should check in for check-in times for other flights on your trip. Flight check-in times can be found in our schedule or obtained from us or our authorized representatives.

 

6.2 You must be at the departure gate no later than the time we notify you at check-in.

 

6.3 We may cancel your seat if you do not arrive on time.

 

6.4 We will not be liable to you for any damage or expense incurred as a result of your failure to comply with the provisions of this Article. If you are not at the times indicated at check-in or at the departure gate, please contact our staff immediately.

 

 

ARTICLE 7 REFUSAL AND RESTRICTIONS ON CARRIAGE

 

7.1 RIGHT TO REFUSE CARRIAGE

 

In our reasonable discretion, we may refuse to carry you or your Baggage if we have notified you in writing that we will not carry you at any time after the date of such notice. In this situation, you are entitled to a refund.

 

We may also refuse to carry you or your Baggage if one or more of the following has occurred or we reasonably believe may occur:

 

7.1.1 such action is necessary to comply with applicable government laws, regulations or ordinances;

 

7.1.2 the carriage of you or your Baggage may endanger or affect the safety, health or essential comfort of other passengers or crew;

 

7.1.3 your mental or physical condition, including being under the influence of alcohol or drugs, endangers yourself, your passengers, your crew or your property;

 

7.1.4 you have committed misconduct on a previous flight and we have reason to believe that such conduct may recur;

 

7.1.5 you have refused to submit to security screening;

 

7.1.6 you have not paid the applicable price, taxes or fees;

 

7.1.7 you do not appear to have valid travel documents, you may attempt to enter the country through which you are in transit or do not have valid travel documents, destroy the documents during the flight or refuse to hand over your travel documents to the flight crew against a receipt;

 

7.1.8 you present a ticket that has been illegally obtained, purchased from anyone other than us or an authorized representative, or has been reported lost or stolen, is counterfeit or you cannot prove that you are the person named on the ticket;

 

7.1.9 you have not complied with the requirements set out in section 3.3 above for the order and use of the coupon or present a ticket that has been issued or altered in any way other than by us or our authorized representative or the ticket has been damaged;

 

7.1.10 you do not follow our safety instructions.

 

7.2 SPECIAL ASSISTANCE

 

Acceptance of the carriage of unaccompanied children, persons with reduced mobility, pregnant women, the sick or other persons with special needs requires prior agreement with us. Passengers with disabilities who have notified us of their disability and any special requirements at the time of ticket purchase and who have expressly agreed to them in writing may not subsequently be denied boarding on the basis of such express disability or special requirements.

 

ARTICLE 8 - LUGGAGE

 

8.1 FREE LUGGAGE

 

You may carry some of your Baggage free of charge subject to our terms and conditions, which are available upon request from us or our authorized representatives.

 

8.2 ADDITIONAL LUGGAGE

 

You will have to pay a fee for the carriage of luggage in excess of the free amount of luggage. These prices are available from us on request.

 

8.3 ITEMS NOT ACCEPTED AS LUGGAGE

 

8.3.1 You may not include in your Baggage:

 

8.3.1.1 objects that may endanger the aircraft or its occupants and property, such as those specified in: International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air, International Air Transport Association (IATA) Dangerous Goods Regulations and Regulations (more information available on request);

 

8.3.1.2 goods the carriage of which is prohibited in accordance with the applicable laws, regulations or ordinances of any State from or to which we fly;

 

8.3.1.3 goods which we consider unsuitable for carriage because they are dangerous, unsafe or because of their weight, size, shape or nature, or which are fragile or perishable, taking into account, inter alia, the type of airplane in use. Information on unsuitable goods is available on request.

 

8.3.2 Carriage of firearms and ammunition other than for hunting and sporting purposes as luggage is prohibited. Firearms and ammunition for hunting and sporting purposes may be accepted as checked baggage. Firearms must be packed unloaded separately from the ammunition and the safety catch on and packed properly. The transport of ammunition is subject to the provisions of ICAO and IATA as defined in 8.3.1.1.

 

8.3.3 Weapons such as antique weapons, swords, knives and similar items may be accepted as checked baggage at our discretion, but are not permitted in the cabin of an aircraft.

 

8.3.4 Checked Baggage shall not contain money, jewelery, precious metals, computers, cameras, mobile phones, electronic devices, musical instruments, glasses / sunglasses, keys, medicines, securities or other valuables, certificates, bonds and other valuables, commercial documents. other identity cards or samples.

 

8.3.5 If, despite the prohibitions, your luggage contains items referred to in paragraphs 8.3.1, 8.3.2 and 8.3.4, you will be liable for any damage caused by such items. Damage to such items is subject to the limitations of liability under the Convention in accordance with the applicable Convention. We will not be liable if the damage is due to an inherent defect, quality or defect in the Baggage.

 

8.3.6 Unless otherwise required by applicable Finnish law, we will not be liable for any damage to your Baggage caused by the property contained in the Baggage. Any passenger whose property causes damage to another passenger's luggage or JS Aviation's property shall indemnify and be liable for all losses and expenses incurred by us as a result.

 

8.4 RIGHT TO REFUSE CARRIAGE

 

8.4.1 Subject to 8.3.2 and 8.3.3, we will refuse to carry as baggage any items described in

8.3, and we may refuse to continue to carry such goods after finding such.

 

8.4.2 We may refuse to carry any goods due to their size, shape, weight, contents or nature, or for safety or operational reasons or for the convenience of other passengers.

 

8.4.3 We may refuse to accept Baggage for carriage unless, in our reasonable opinion, it is properly and securely packed in suitable means of transport. Information on packaging and means of transport that cannot be accepted by us is available upon request.

 

8.5 RIGHT OF INSPECTION

 

For security reasons, you allow an identity check and scan, as well as an inspection, scan, or x-ray of your luggage. If you are not available, your Baggage may be inspected in your absence to determine if you are in possession of or have in your Baggage any item described in Section 8.3.1 or firearms, ammunition or weapons not handed over to us in accordance with Section 8.3.2 or 8.3.3. If you do not wish to comply with the request, we may refuse to carry you and your baggage. If an inspection or scan causes damage to you, or an inspection, scan or X-ray causes damage to your luggage, we will not be liable for any damage unless it is due to our fault or negligence.

 

8.6 CHECKED BAGGAGE

 

8.6.1 When you provide us with your Baggage that you wish to check in, we will take these for carriage and provide a Baggage Identification Tag for each of your Checked Baggage.

 

8.6.2 Your name or other personal identification number must be affixed to checked baggage.

 

8.6.3 Whenever possible, checked baggage shall be carried on the same aircraft as you, unless it is decided for safety or operational reasons to carry it on an alternative flight. If your checked baggage is carried on the next flight, we will deliver it to you, unless applicable law requires you to be present at customs clearance.

 

8.7 UNCHECKED BAGGAGE

 

8.7.1 Baggage that you carry in an aircraft must be in a cabin under the seat in front of you or in an enclosed storage area. If your luggage cannot be stored in this way or if it is in excess or if it is considered dangerous for any reason, it must be carried as checked baggage. We can determine the maximum dimensions and / or weight for luggage that you can take with you on the plane.

 

8.7.2 Items that cannot be carried in the luggage compartment (such as sensitive musical instruments) and that do not meet the requirements of 8.8.1 will only be accepted for carriage in the cabin if you have notified us in advance and given permission. You may be charged a separate fee for this service.

 

8.8 COLLECTION AND DELIVERY OF CHECKED BAGGAGE

 

8.8.1 Subject to Section 8.6.3, you must collect your Checked Baggage as soon as it is available at your destination or stopover. If you do not pick it up within a reasonable time, we may charge you a storage fee. If checked baggage is not picked up within three (3) months of being made available, we may dispose of it without any liability to you.

 

8.8.2 Only​​ the holder of the baggage inspection and baggage tag has the right to receive the checked baggage.

 

8.8.3 If the person collecting the Checked Baggage is unable to present the Baggage Receipt and identify the Baggage using the Baggage Identifier, we will only deliver the Baggage to that Person provided that he or she satisfactorily proves his or her right to the Baggage.

 

8.9 ANIMALS

 

If we agree to transport your animals, they will be transported under the following conditions:

 

8.9.1 You must ensure that animals, such as dogs, cats, poultry and other pets, are properly packed in a means of transport (cage, etc.) and are accompanied by valid health and vaccination certificates, entry permits and other documents required by countries of entry or transit. . If this is not the case, the animals will not be accepted for transport. Such shipment may be subject to additional terms and conditions specified by us and available upon request.

 

8.9.2 If an animal is accepted as baggage, it may not be included in the free baggage allowance together with its container and food, but will constitute additional baggage for which you must pay the applicable fees.

 

8.9.3 Guide dogs accompanying passengers with disabilities will be transported free of charge in addition to the normal free baggage on our terms and conditions, which are available on request.

 

8.9.4 We are not responsible for the injury or loss, illness or death of an animal that we have promised to transport unless we are negligent.

 

8.9.5 We are not responsible for any animal that does not have all the necessary exit, entry, health and other documents related to the entry or transit of the animal into any country, state or territory, and the person transporting the animal must reimburse us for the costs, losses or liabilities reasonably imposed or incurred by us.

 

 

ARTICLE 9 - TIMETABLES AND DEROGATIONS

 

9.1 SCHEDULES

 

9.1.1 The flight times shown in the schedules may change between the date of publication and the actual date of travel.

 

9.1.2 Before accepting a booking, we will inform you of your scheduled departure time. We may need to change your scheduled departure time after your ticket has been issued. If you provide us with contact information, we will endeavor to notify you of any such changes.

 

ARTICLE 10 - REFUNDS

 

10.1 We will refund the payment made under the agreement if the refundability is specified in the order agreement or in the confirmation and receipt of the connecting flight.

 

10.2 CURRENCY

 

We reserve the right to make a refund using the same payment method and currency used to pay for the ticket.

 

ARTICLE 11 - OPERATIONS ON AIRCRAFT

 

11.1 GENERAL

 

If, in our reasonable opinion, you are behaving in an airplane endangering the aircraft or any person or property on board or obstructing the crew in the performance of their duties, or if you are not following the crew's instructions, including but not limited to smoking, alcohol or drug use, or inconvenience, inconvenience or injury or injury to other passengers or crew members, we may​​ such measures as we deem reasonably necessary to prevent the continuation of such conduct, including tying. You may be removed from the aircraft and we may refuse to carry you on at any time and you may be prosecuted for any crimes committed on board the aircraft.

 

11.2 ELECTRONIC DEVICES

 

For safety reasons, we may prohibit or restrict the operation of electronic devices, such as mobile phones, laptops, portable recorders, portable radios, CD and MP3 players, electronic games or broadcast devices, including radio-controlled toys and radio telephones on an aircraft. The use of hearing aids and pacemakers is permitted.

 

ARTICLE 12 - ARRANGEMENTS FOR ADDITIONAL SERVICES

 

12.1 If we make arrangements with a third party to provide services other than air transportation, or if we provide a ticket or voucher relating to transportation or services (other than air transportation) provided by a third party, such as hotel reservations or car rental, we will only act as your agent. The terms of the third party service provider apply. We will not be liable to you for such services, except for our negligence in making such arrangements.

 

12.2 If we also offer you ground transportation, other conditions may apply to such ground transportation. Such terms and conditions are available from us upon request.

 

ARTICLE 13 —ADMINISTRATIVE FORMALITIES

 

13.1 GENERAL

 

13.1.1 You are responsible for obtaining all required travel documents and visas and for complying with the laws, regulations, ordinances, requirements and travel requirements of all countries from which you fly, to or through which you travel.

 

13.1.2 We are not responsible for the consequences for passengers of not receiving such​​ documents or visas or fail to comply with any laws, regulations, ordinances, requirements, requirements, rules or guidelines.

 

13.2 TRAVEL DOCUMENTS

 

Prior to the trip, you must present all exit, entry, health and other documents required by the laws, regulations, orders, requirements or other requirements of those countries and allow us to take and retain copies of them. We reserve the right to refuse carriage if you have not complied with these requirements or if your travel documents do not appear to be in order.

 

13.3 Refusal of entry

 

If you are denied access to any country, you will be required to pay any fines or fees assessed to us by the relevant government and the cost of transporting you from that country. We will not refund the price charged for transportation to the point of refusal or denial of access.

 

13.4 THE PASSENGER IS RESPONSIBLE FOR FINES, DETENTION COSTS, ETC.

 

If we are required to pay fines or penalties or to pay costs for non-compliance with the laws, regulations, requirements or other travel requirements of the countries concerned or to provide the required documents, you must reimburse us for any amounts so paid or incurred. We may apply to such charges or expenses the value of any unused transportation of your ticket or the funds in our possession.

 

13.5 CUSTOMS INSPECTION

 

If necessary, you should participate in baggage screening by customs or other government officials. We will not be liable to you for any loss or damage incurred by you during such inspection or for failure to comply with this requirement.

 

13.6 SECURITY INSPECTION

 

You must submit to security checks by governments, airport officials, carriers or us.

 

ARTICLE 14 - NOT APPLICABLE

 

ARTICLE 15 - LIABILITY FOR DAMAGES

 

15.1 The liability of JS Aviation and each Driver participating in your journey will be governed by its own Conditions of Carriage. Our liability conditions are as follows:

 

Limits of liability for damage to passengers and their luggage

 

15.1.1 (a) Compensation in the event of death or injury

Liability is limited to the level of liability insurance for the aircraft used in the operation.

 

15.1.1 (d) Destruction, loss of or other damage to Baggage and delays

In the case of checked baggage, JS Aviation is liable even if it has not made a mistake, unless the baggage is defective. In the case of unchecked baggage, JS Aviation is only liable for the error. In the event of delay in baggage, JS Aviation will be liable for damages unless it has taken all reasonable steps to avoid the damage or it is impossible to take such steps. Liability for destruction, loss of or other damage to baggage or delay in baggage is limited to the amount stated in the liability insurance for the aircraft used in the operation.

 

15.1.2 Other terms and disclaimers:

 

15.1.2 (a) All of our liability for damages is reduced by any negligence on your part that causes or contributes to the Damage under applicable law.

 

15.1.2 (b) We will not be liable for any damages resulting from or failure to comply with applicable laws or government rules and regulations.

 

15.1.2 (c) Unless otherwise provided in these Conditions of Carriage, we will only be liable to you for foreseeable damages for proven immediate damage. To the extent permitted by applicable law, you agree that we will not be liable for any indirect, consequential or other damages.

 

15.1.2 (d) We will not be liable for any damage caused to your Baggage. You are responsible for any damage that your luggage has caused to other persons or property, including our property.

 

15.1.2 (e) You shall not pack Checked Baggage with items that may not be included in Checked Baggage under 8.3, including sensitive or perishable items, special items or personal items.​​ essentials such as money, jewelry, precious metals, computers, cameras, mobile phones, electronic devices, musical instruments, glasses / sunglasses, keys, medicines, securities or other valuables, stock certificates, bonds and other valuable documents, company documents and other documents, passports samples. We will not be liable for any damage, loss or consequences if you pack these items in your luggage.

 

15.1.2 (f) We will not be liable for any illness, injury or disability, including death, or aggravation of such condition resulting from your physical condition. We are not responsible for the transmission of any illness from you or other passengers before, during or after the flights.

 

15.1.2 (g) The Contract of Carriage, including these Conditions of Carriage and any exclusions or limitations of liability, shall apply to our authorized representatives, servants, employees and agents in the same manner as us. From us and such authorized representatives, employees,​​ the total amount recovered from agents and individuals shall not exceed our own potential liability.

 

15.1.2 (h) Nothing in these Conditions of Carriage shall exclude any exclusions or limitations of liability imposed by this Convention or applicable law, unless expressly stated otherwise.

 

 

ARTICLE 16 - DEADLINES FOR REQUIREMENTS AND ACTION

 

16.1 STATEMENT OF REQUIREMENTS

 

Unacceptable receipt of baggage by the baggage holder shall constitute sufficient proof that the baggage has been delivered in good condition and in accordance with the contract of carriage, unless proven otherwise.

 

If you wish to make a claim or action for damage to checked baggage, you must notify us as soon as you notice the damage and no later than seven (7) days after receipt of the baggage. If you wish to make a claim or action for delay in checked baggage, you must notify us within 21 (21) days of the baggage being handed over for use. Any such notification shall be made in writing.

 

16.2 LIMITATION OF ACTIONS

 

All rights to compensation shall lapse if the action is not brought within two years of arrival at the destination, the date on which the aircraft was due to arrive or the date on which the carriage stopped. The method of calculating the limitation period shall be determined by the law of the court seised.

 

 

ARTICLE 17 - OTHER CONDITIONS

 

You and your Baggage will also be carried in accordance with certain other terms and conditions that apply to or have been approved by us. These terms and conditions vary from time to time and are important. They concern, inter alia: the carriage of unaccompanied minors, pregnant women and sick passengers, restrictions on the use of electronic equipment and supplies and the use of alcoholic beverages on board aircraft.

ARTICLE 18 - INTERPRETATION

 

The title of each article of these Conditions of Carriage is written for convenience only and should not be used to interpret the text.

 

ARTICLE 19 - AMENDMENTS AND EXEMPTIONS

 

No authorized representative, servant, employee or representative is authorized to change, modify or release anyone from the obligation to comply with the provisions of these Conditions of Carriage.
